After you have filed your application, the Registry will check that your trade mark complies with the requirements for registration and whether there are any similar trade marks already registered.<\/p>\n

If they find a similar trade mark, they will send a letter to the trade mark owner letting them know about your application.  Sometimes the owner of the earlier trade mark will object to the later trade mark.<\/p>\n

The opposition period<\/h3>\n

The Registry will publish details of the application on their website, and those who believe they have a legal right to object to the trade mark can oppose it.  The most common reason for opposing is if someone feels that the trade mark is too similar to their own trade mark.<\/p>

This \u2018opposition period\u2019 lasts for two months. However, where a party is considering opposing a trade mark, they can ask for an extension of one month.<\/p>\n

When there are no issues with trade mark registration, the entire process will take around 4 months.<\/p>\n
