How long does it take to register a trade mark?

However, there are several stages involved in registering a trade mark, and it can take a significant amount of time. We offer an initial assessment that can prevent your trade mark application from being rejected, making the process more efficient.

Objections to trade mark registration

After you have filed your application, the Registry will check that your trade mark complies with the requirements for registration and whether there are any similar trade marks already registered.

If they find a similar trade mark, they will send a letter to the trade mark owner letting them know about your application.  Sometimes the owner of the earlier trade mark will object to the later trade mark.

The opposition period

The Registry will publish details of the application on their website, and those who believe they have a legal right to object to the trade mark can oppose it.  The most common reason for opposing is if someone feels that the trade mark is too similar to their own trade mark.

This ‘opposition period’ lasts for two months. However, where a party is considering opposing a trade mark, they can ask for an extension of one month.

When there are no issues with trade mark registration, the entire process will take around 4 months.

Application submitted with Intellectual Property Office

Once your application details have been approved and finalised, your application will be formally submitted to the Intellectual Property Office. This typically happens within 3 days of submitting your order with us, but this can take longer if there are complications.

Intellectual Property Office Examination report

The intellectual property office will now check the application to make sure it meets their criteria. This usually takes around two weeks but they allow themselves up to 40 working days.

Application Published

If the examiner has no objections your application will be published in the trade mark journal.

Opposition Phase

Your application is now “pending” and is open to opposition from third parties.  The 2-month timeframe can be extended to 3 months if a third party feels there are grounds for opposition.

Provided nobody has objected, your trade mark will become registered approximately two weeks after the opposition period ends
