Not everything is allowed to be registered as a trade mark.
- A trade mark can't be too descriptive. For example, an application to register NUTTY for nuts is likely to be refused. You can sometimes overcome this problem by adding something non-descriptive, before filing, see below.
- Deceptive of the product / service applied for. For example, an application for GOLDiful for plastic jewellery would be rejected on the basis that people would think that jewellery was made of gold.
- A banned type of trade mark, in short that relates to the British royal family or which includes state emblems like flags aren’t allowed.
- Offensive, e.g. pornographic words or images, or words or images that suggest illegality.
If the Registry reject your trade mark on this basis they do not give a refund of the application fees. We will let you know if this happens and give you the option to either take advice on whether we might be able to persuade the Registry to change their mind or to abandon the application. If your trade mark application fails on this basis although you will have paid the government fee, we will waive our fee on your next application provided you re-file within 30 working days. If you think your trade mark is too descriptive, you can add a logo or fancy typeface to reduce the chance the Registry will reject your trade mark.

What territories are included in the UK and EU?
UK trade marks cover England, Scotland, Wales and Northern Ireland.
EU trade marks cover all 27 EU member states being Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden.
What are Classes?
A trade mark must specify the type of products or services where it will be used. Classes 1 - 34 are for "Goods" (physical products) whereas 35 - 45 are for services. For example, Nike would register in class 18 to cover bags and class 25 to cover clothing.
A trade mark must have at least one class. If you need help finding the appropriate class, click on the magnifying glass to open the "class finder" to search for the appropriate classes for your trade mark.

Depending on your search results, you can decide how you'd like to proceed. The trade mark review is a good option if the automated search found results or if there are other close results which you believe may cause a problem.
